Referendum & Election
Gen. Musharraf has made every thing a comedy as well as a tragedy. In this drama he would go to any extent and make fun of constitution, commandment, laws and rules & regulation. He perhaps knew very well that Pakistan army and public would not react and he could throw bones to the army officers to get their loyal support and fear of America would forces these officers to wriggle their tails and lick his shoes just like he is wriggling his tail and licking shoes of America. He can then use Pakistan army just like British who used local people to serve them against their own people and hence were able to rule subcontinent with as little as 10,000 British soldiers. Musharraf therefore did things which were absolutely and glitteringly ridiculous and outrageous he liked and his bosses in Tel Aviv and New York would support this comedian puppet and clown as long as he was serving their purpose. As Andrew's article appeared in a Lahore weekly "Independent" that such people we can buy two a dollar so if he is toppled or assassinated so be it. We would just keep increasing our pressure on him and put him against the wall till one of the two above mentioned things happen. I may say here that his bosses may have been surprised that how far Musharraf can fly and how much insult Pakistanis can take!
Pakistan's military dictator organized a fake election in the name of "Referendum" to extend his life as President for next five year. He earlier issued a referendum order on 9 April 2002. That stated that "No court, tribunal or other authority shall call in question, or permit to be called in question, the validity of any provision of this order or any thing done or action taken, or purporting to be done or taken, there under on any ground whatsoever or grant an injunction, make any order to entertain any proceedings in respect of any matter provided for in this order or arising there from".
"All disputes as to the result of the referendum shall be finally decided by the Commission and no court or other authority shall have any jurisdiction to entertain any proceeding relating thereto"
The order further states that it overrides the constitution. At present, all judges of Supreme Court and High Courts are working under direct military dictatorship as they have taken an oath to obey it rather than the constitution. All those judges who found this oath against their conscience and did not take were forcefully sent home by the military dictator earlier. Interestingly Pakistani constitution calls for death penalty for anyone who tempers with the constitution. Pakistan's military dictator is also widely believed to have assassinated famous lawyer Mr. Iqbal Ra'd and his assistant on one Friday when the lawyer claimed to expose the reality of plane hijack drama.
In order to please Uncle Sam and other Governments of West Pervez Musharraf has played the drama of referendum for which he was working so hard for last two weeks. Pakistani Constitution permits referendum on single issue and not on a policy that contains thousands of issues let alone policies that would contain hundreds of thousands of issues. Today Pakistani public was asked to vote in the form Yes or No for continuation of Musharraf policies. If they voted Yes, Musharraf will continue for another five years. In this manner, the referendum automatically became an election. An election without any opposing candidate! When I, a well educated physician and a professor asked Election Commission to enter my name on the referendum ballot also, the Election Commission simply ignored the request to give Musharraf a single man show and full chance to get "elected". When an European journalist asked Musharraf representative what would be the minimal percentage if he did not secure he will pack and go. There was no answer. The General will decide then. The real answer was that it can't happen. Angles will descend from heaven and fill those all election boxes as there would be no representatives of the opposition will be there to verify the fairness of the process.
In fact, Pakistan armed forces personnel were forced to vote for the General as the voting was not transparent and officers' personal number of the army was entered along with his vote. Any no vote meant good-bye to future promotion and adverse remarks in the personal file. Even the Executive Directors of the hospitals were not spared. They were ordered to gather public for the "˜Support caravans" for Pervez Musharraf. All paramedical staff and nurses were ordered to take part in these caravans and chant slogans for the General. Their attendance would be marked. Those who did not appear will be dealt with an iron hand. This was the case for example at Pakistan Institute of Medical Sciences Islamabad (PIMS), the most prestigious hospital. Here polling booths were established where by force many people were brought to vote for the General. Of course a few came on there on. These generally included Qadyani minority whose central leader Mirza Tahir had openly ordered to give full backing to the General whose wife Sehba is regarded Qadyani by many. It should be also noted the General has an under the table deal with PPP whose central leader's husband Asif Zardari had been allocated 13 private rooms along with mobile phone, hot water bath tub, dish antenna, computers, cable TV etc in addition to 13 nurses and 70 policemen. Asif Zardari is known as Mr. 10% as he used to take at least 10% commission on any Government deals. Gen. Pervaiz Musharraf despite making tall claims to curtail corruption and to recover all looted wealth had not been able to get back a single penny form Asif Zardari. On the other hand Gen. Musharraf had managed to give dry cleaning to those politicians who had supported his so-called referendum com elections. These included Mr. Aftab Sher Pao who was found guilty by a court and later under Government instruction not found guilty after his assurance of support to Gen. Musharraf.
Islamabad like many other cities of Pakistan was fully littered with ugly banners of support for Musharraf. Literally millions of yard of expensive cloth was used. No one was allowed to hang anti Musharraf banner. Those who dared to do so were arrested by police. For example Arabic Teaching College's principal and students were arrested when they try to put banners opposing Musharraf in Islamabad. Only about 04% participated and these included some under age nursing students at PIMS were forced to vote for Musharraf. Some political parties had already complained that many boxes were filled with yes votes before the election cum referendum commenced.
The Western democracy is a drama to a great extent, which we would Insha Allah discuss in next chapter in some detail. No doubt it gives some openness and freedom. But it is very limited freedom indeed. In USA 3% Zionists and in India 3% Brahmins are ruling over 97% through this drama. However the voting and election are honest in terms of election of people. But in Pakistan at times the entire process is irregularly irregular. In order to legitimize his presidency, Musharraf played the dramas of referendum & election. First was extremely unconstitutional, above law and totally fraud. The second was rigged at many stages. I personally filed following petitions to the Chief Election Commissioner and got them stamp my copy. As expected despite officially receiving my application the Election Commissioner did not reply and did not allow including my name on the ballot paper in order to have some contest. But what I did not expect but happened that all record of referendum was burnt to ashes by Musharraf using Justice Irshad Hussain then Chief Election Commissioner! The current referendum is as a matter of fact a fraudulent election with a solo self-appointed forced candidate. The constitution gives detailed and specific modus operandi of choosing a President that cannot be bypassed through fraudulent arguments backed by brutal force and on exchequers expense. It is the right of every able Pakistani to contest election and it is the right of every Pakistani citizen to choose the person of his/her choice as President of Pakistan for next five years. No body has the right to snatch away that right from people under any context.
There is a specific provision for holding referendum in the form of yes or no to a specific issue and not for electing a president for next five years or about continuation of policies that include literally hundreds of thousands of issues. Approval or disapproval of those policies is called "Election of Government" in all civilized countries. The nation is being made a fool in bright day light through official propaganda machinery and lavish expenses on banners, festivals, caravans, public gatherings, abducting public vehicles, forcing people to attend meetings and raising hands in favor of one solo self appointed candidate.
I have filed a request to you and the Chief Justice of Pakistan to convert this referendum into a democratic election by including my name on the ballot as an alternate candidate to Gen. Musharraf.
I can assure you that by grace of Allah I am eligible under section 62 (Ethical and
Moral Standards of a candidate) of Constitution of Islamic Republic of Pakistan
while I wish I could say the same about my opponent!
If my name is printed on the ballot I will request you to also give me ample time on PTV and radio Pakistan to brief my people about myself, my aims and objective to make Pakistan a Modern, Prosperous, Peaceful, Brave and leader of the world in due time
At the same time may I request you, my honor set up an inquiry into gross abuse of public money by Musharraf. Moreover all those organizations and persons who have drastically littered this country with his cheap "Filmi" posters may asked to account for their enormous wealth and the taxes they have paid.
My Honor: A sovo motto action by you on my humble request my change the destination of this country from downhill course to a upward progress as no nation and country can thrive without sound ethical and moral foundation.

I also filed a petition in the Supreme Court of Pakistan which is reproduced here. Sadly the Supreme Court does not answer to individual letters and petitions unless they are brought to the court through "proper" procedures. I learnt latter that thousands of letters asking for justice from all over Pakistan from very poor and from uneducated people arrive at Supreme Court of Pakistan for help but fell on the deaf ears of the Judges just because the matter is not written or presented in a specific format. What could be more killing of justice? Even the letters are no acknowledged and answered to tell the poor petitioners to guide them to how to file the petitions. The honorable judges are not however ready to leave their British inherited perks and privileges and go on leave for months as British judges use to go Great Britain on ships in those days and would take weeks to go and come back. So when it comes to our advantage, we love slavery and continuation of the laws so we are dishonest to the core and want to keep this dishonesty as long as it serves ourselves. Anyway I have reproduced my petition below:

Dear Honorable and Respected Judges: Assalamo Alaikum
I as an ordinary, educated and responsible citizen hereby challenge the President Gen. Musharraf's order of holding a national referendum as:
1. An outright Fraud
2. Illegal and unconstitutional
3. Theft on public money
4. An attempt to continue his role as his master's voice on behalf of international global terrorist i.e. Bush and Sharon administration
5. To avoid such "painful" judiciary inquiry as the murder of late advocate Iqbal Ra'd who had promised to uncover the truth behind plane hijacking
Now briefly I will describe my contention as follows:
- An outright fraud:
The so-called referendum is a sham election whereby peoples' right to choose from the best candidates is unlawfully snatched away. Approval or disapproval of one single issue cannot bestow a crown on the head of someone to rule this country for next five years. It would have been much more honest although still a dictatorial and illegal if Pervaiz Musharraf would have simply extended his control over Government for next five years. After all that is going on in many banana republics across the globe. This fraud is no less than a fraud of Gen. Zia ul Haque who declared that voting for Islam would automatically mean his continuation of presidency for next five years. My Dear Honorable and Respected Judges: Allah is judging you and all of us. There is another court there. One fraud cannot justify another fraud even if any court due to pressure, ideology of necessity or other compelling reasons of lesser evil might have provided a rescue to a dictatorial and unconstitutional and illegal Government. If we give a legal coverage to this fraud then we are going to open a perpetual door of dictatorship over this country and people of ours with enormous damage to our coming generations. We must look beyond our present petty interests. What are we going to leave behind for our grand daughters and grandsons are more important; a civilized country or a banana republic of remote African village type?
- Illegal and Unconstitutional:

It is the right of every able Pakistani to contest election and it is the right of every Pakistani citizen to choose the person of his/her choice as President of Pakistan for next five years. No body has the right to snatch away that right from people under any context. There is a provision for holding referendum in the form of yes or no to a specific issue and not for electing a president for next five years or about continuation of policies that include literally hundreds of thousands of issues. For example Educational policy may involve thousands of issues. It will be foolish to ask people to give their approval or disapproval of entire policy. Perhaps no will agree with all the issues of the policy. You may agree to 90% issues for example and yet you may disagree with 10% issues. Referendums are carried out for example to such bipolar issues as extension of one hour in Summer or to help or not the Global terrorists against innocent Muslims. If you include various different spheres of Government it automatically become hundreds of thousands of issues and one can not hold referendum in simple terms such as Yes or No. Approval or disapproval of those policies is called "Election of Government" in all civilized countries. Holding so-called referendum to get Government going is illegal and unconstitutional.
- Theft on Public Money:
The nation is being made a fool in bright day light through official propaganda machinery and lavish expenses on banners, festivals, caravans, public gatherings, abducting public vehicles, forcing people to attend meetings and raising hands in favour of one solo self appointed candidate. Nauseating and disgusting cheap discussions, peoples' statements and vulgar songs all in one direction compound this. This reminds us the practices in many communist and not democratic Governments. Unfortunately in a country where every thing is made expensive by repeated price hikes on instructions of IMF and World Bank, public money is stolen and spend on littering the entire Pakistan with cheap filmi posters. At this juncture may I request your Honor to set up an inquiry into gross abuse of public money by all those organizations and persons who have drastically littered this country with his cheap "Filmi" posters to account for their enormous wealth and the taxes they have paid.
- His Role as His Master's Voice:
Pervaiz Musharraf had become a darling of the forces hostile to Muslims across the globe. Twice on CNN it had been told to the world that Sharon, the brutal Israeli Prime Minister prays for long life of Pervaiz Musharraf before going to bed every night. USA Foreign Secretary Mr. Powell had apparently confirmed this. One USA Senator on Fox News had claimed that Musharraf had 100% surrendered to USA. Naturally all hostile forces against Islam and Muslims are backing Pervaiz Musharraf and they want to continue his role as His master's voice. But that role means slavery for entire Pakistan and all Pakistanis. The same forces had toppled the elected Government of Dr. Mussadiq in Iran and imposed Shah with all his brutalities for years on Iranian people. As Pakistan was liberated after enormous sacrifices it becomes a must on all Pakistanis in uniform or not in uniform, whether in judiciary or in general bureaucracy to defend the freedom of this very country by every possible means. Not to do so will constitute a breach with All Mighty Allah and the oath to the constitution of Pakistan.
- Avoidance of Painful Inquiries:
It is easy to not to face trials when you are in power. The unanswered question about tragic killing of advocate Iqbal Ra'd and his assistant will not go away. Mr. Ra's as every one remembers from his last statement, had complained that Governmental agencies had stolen his fax machine and had tried to tamper with his documents etc. He had categorically said that he would prove in the Court that plane hijacking was a melodrama. Similarly how and why an ambassador had been handed over to Kuffar. Killing of numerous innocent Afghani children awaits inquiries to determine Pervaiz Musharraf's role in assisting the Global Terrorists. It should be noted here that there is no proof at all that Muslims had any role in attacks on World Trade Center at all. On contrary there are all the proofs that Israelis had attacked the World Trade Center. The Bush video of Osama is a totally fake video, as I have enclosed the title pictures of real Osama and the fake Osama in the Bush Video. Even a child of two year of age will immediately recognize that the two people are quite different. Bush had actually employed a Holly Wood actor to write a proof. Dear Honorable Judges even Pervaiz Musharraf had said that the proofs were sufficient to register only a case. But registering a case and punishing someone on such cooked up proofs are two entirely different things. My honor since the crimes had been committed that are of gravest nature in human history and in the sight of Allah and all those who fear Allah, my contention is that Pervaiz Musharraf wants the entire assembly under his thumb so that no one can discuss the matters in the assembly and if someone does it he/she may face the fate of Mr. Iqbal Ra'd and/or the assemblies are packed. My honor because of a weak Pakistan Indian Government another State and Global Terrorist had courage to actively plan and kill Muslims in Gujrat where so far over 5000 Muslims have massacred. The deceptive slogan "Pakistan First" of course serves the purpose of the enemies of Islam and Muslim Ummah who have ruled and are still ruling the Muslims world trough creation of sectarian, geographical and national divides. There is no Muhammad Bin Qasim any more who can respond to the enormous sufferings of Palestinian, Kashmiri and Indian Muslims.
My Honor my appeal to you is to:
1) Declare the order of Pervaiz Musharraf of holding referendum as null and void
2) Dissolve the Government and let Supreme Court take over as the interim Government to hold elections fair and transparent as in Bangla Desh. With clear-cut intentions of prolonging his power by hook or crook Pervaiz Musharraf has exposed himself to the extent that he is no longer capable of holding a fair and unbiased election. If constitution is silent about carrying out an election by Supreme Court so is the case for a military Government. But anyone in the country can judge that the people and the world will have confidence in an election held under direct supervision of Supreme Court of Pakistan. A freely and fairly elected Government will have a credibility and strength that will not be enjoyed by a Government that would be widely perceived as a Banana republic in the world. A truly democratically elected Government will enhance the image of Pakistan as a civilized country while a dubiously elected Government will further shatter the image of Pakistan and that will affect all Pakistanis in one way or other e.g. in obtaining visa for travel and having business opportunities etc.
3) Follow the constitution in election of new assemblies and Government disregarding all illegal and unnecessary amendments made by Pervaiz Musharraf as he has no right to make such amendments
4) Set up an inquiry to determine the abuse of public money on holding self projecting rallies, banners, newspaper advertisements, TV and radio time on one sided propaganda and recover the looted wealth from the account of Mr. Pervaiz Musharraf.
5) Army to go back to barracks where they belong and to devote their full attention to defense of Pakistan rather than indulging in domestic and international affairs which no civilized country allows.

of Human Rights
Dear Justice Irshad Hussain: Assalamo Alaikum.
All praises are due to Allah who has created me, you and the entire universe. His power is over the smallest particle to the largest galaxies. Each cell of our body is under his control. If He takes away any blessings none can bring back and if He showers any mercy none can stop. All blessings and mercy be upon the last and the final Prophet of Allah Syedna Muhammad (Peace be upon him) because of whom we received Allah's chosen path i.e. Islam.
Muslims are supposed to be the torchbearers as they are the one who possess un-adulterated book of Allah i.e. Quran-e-Majeed. We are the chosen people to walk on the right path and to guide others. If we get astray, we deserve double punishment. We know that Allah has appointed two angles on each of us who record every word we utter and every act we do. Allah knows our thoughts before they emerge. He is aware of what is hidden and what is obvious. We have little time to live and we shall soon end up in grave and after grave on the Day of Judgment. Indeed successful is the one who succeeds on that day and the failure is the one who fails on that day.
After that please let me register my official complaint in your office as well as in the office of Allah Ta'lah. I had earlier sent you two letters that were duly received by your esteemed office regarding referendum (Appendix: A) but I have not received any reply. I had requested you to kindly put my name along with General Musharraf on the referendum ballot. If you did not approve my request, you should have answered my letter regretting and giving the reasons. By Grace of Allah, I am highly educated mature person and had been a physician and member of the faulty of one of the top most USA University Hospitals. I by Grace of Allah had been the recipient of Best over all Research Award at Kansas University Hospital in 1981. I had several publications of high standards in the most prestigious medical journals and my work had been quoted in the recent advances in pathology.
I thought in all fairness that given the chance I would have been a better President than Gen. Musharraf for Pakistan would, however the Election Commission has deprived me to contest an election which is the right of every citizen of Pakistan and deprived the nation to elect a better candidate. Allah knows my heart that I have no desire to become the President of this nation and to carry such huge responsibility but it was to stop the leadership of a person who in my opinion has committed grave crimes against the nation and the country. These crimes include tempering with constitution of Pakistan which itself calls for death penalty and his toppling of the Elected President of Pakistan and elected houses for no reasons. Not to say his role in killing of famous advocate Iqbal Ra'd and his assistant as well as numerous human innocent human beings in Afghanistan. The Supreme Court of Pakistan is not free and it is working under the dictatorship of Gen. Pervez Musharraf, as was amply clear form its own decisions in referendum petitions etc. Moreover, the order of referendum clearly says that it is not challengeable in any court. Well I am challenging that in the highest court that is the court of Allah Ta'lah.
I have solid reasons to prove that:
01 Referendum was unconstitutional
02 Referendum was unscientific, illogical and against common sense. Referendum can be held to test one single issue in the form of yes or no. It can't be held to test hundreds of thousands of issues that are included in policies let alone a policy, hence scientifically it was wrong, and all conclusions drawn from it are wrong and false. You can't simply give yes or no to all issues is single answer.
03 Referendum cannot replace elections by any logic. It has deprived far more suitable candidates to contest and nation the right to choose the better and more suitable candidate. If it were such an acceptable method of choosing president then I am sure USA would have adopted this system instead of elections of President.
04 Referendum has made the coming elections a total useless exercise. The newly elected parliament and prime minister would be under direct threat of the so-called president. USA Government likes good and obedient dictators and do not care at all about democracy (Appendix: B) the President who had already become a part of global terrorism against Muslims will implement Uncle Sam's policies on Pakistani nation thus indirectly making Pakistan a slave country which is against the oath of allegiance to this country, its armed forces, constitution and people. While Qaid-e-Azam Muhammad Ali Jinah and other great leaders gave us a free country, the act of so-called referendum will make it a salve country. These are not premature assumptions except if one has decided to bury his head under sand. Pakistan's Pak land had been made open for foreign troops by Pervez Musharraf. This fact is felt and realized by most people and some retired honorable judges openly expressed their opinion supporting my conclusion. (Appendix: C)
05 To get his power extended for next five years, Gen. Musharraf has abused poor people's money on lavish banners, sign boards, rallies, newspaper advertisements, TV and radio time etc. etc. Together this amount sot corruption and wastage of many Billions of rupees. Is this not a massive corruption?

06 Gen. Pervez Musharraf had used Nazims, councilors and other members of "elected local body" personnel for his selfish cause. Many Nazims, Naib Nazims, Councilors were forced (albeit in subtle manner) to bring people to attend meetings for Pervez Musharraf in illegally and forcefully snatched private buses etc. Government employees who are not supposed to take part in political rallies were ordered to attend the rallies in plane clothes. For example, employees of Pakistan Institute of Medical Sciences (PIMS) were forced to attend these rallies. They were threatened that the roll call will be taken and those missing will face unpleasant consequences. (Appendix: E)
07 As there was total lack of confidence in himself Pervez Musharraf not only chose to not to take off his uniform and participate in fair and open elections but he first tied the feet of all other possible contenders and then put Government jet wheels under his feet to win the race! All practical steps were taken to make facilitate bogus voting that is well reported by local as well as international press. Elimination of voters list, accepting alternate loose means of identity and absence of representatives of political parties and/or common honest citizens were three important measures among many others to carry out this millennium fraud. The nation showed great maturity and did not give legitimacy to this fraud. Hardly five percent voters showed up at polling booths and the empty boxes were then filled by the Government employees at those stations. One person claimed that he has stamped 2400 votes in Sahiwal. One lady claimed that she had voted sixty votes. (Appendix: F) In Washington DC USA and neighboring areas where there is a strong Pakistani community of 150,000 people only 300 people voted keeping in pace with mass and almost total rejection of the referendum and Pervez Musharraf. 08 Instead of accepting a humiliating defeat in the midst of phenomenal irregularities Musharraf claimed victory again trying to fool this nation and the world. As USA Government does not like democracy in Muslim counties and had previously toppled many elected Governments Musharraf is taking full backing of those countries to serve their interest rather than the interest of Pakistan and its people. In this regard, he has committed high treason and has put Pakistan last rather than first. Anyway his deceptive slogan of Pakistan first aims at dividing the Muslim Ummah and weakening it which automatically means weakening of Pakistan as it is part of Muslim Ummah.
09 Some of those who tried to put banners against Musharraf were arrested. One of such person is Mr. Bashir Ahmed, Principal of an Arabic Language College. He has been kept in true Adiala prison (Not like corrupt Asif Zardari who had been given 12 rooms at PIMS with all luxuries and PIMS had been declared as "Adiala Sub-jail")
10 As the gross fraud is witnessed by all people including children,
what moral and ethical lesson we have taught to this nation?
That our leaders are corrupt, our justice department is
Corrupt, our election commission is corrupt and our armed
Forces give full backing to the corrupt leaders particularly if
they are in uniform. Such immoral and unethical teachings
would be the worst poison being injected into the veins of this
nation
Request:
A. My request to you is to kindly cancel the results of the referendum immediately as it is the fraud of the millennium.
B. To call for witness on voluntary bases from throughout Pakistan. Let people both Government employees and others be allowed to record their witnesses with full immunity and protection under the oath of Quran.
C. If and Insha Allah it will be proved that massive irregularities had been carried out then the culprits be punished and all stolen money amounting many billions of rupees must be recovered from them
D. Government must be dissolved and the new elections be held under neutral Government headed by those honorable and respected judges who demonstrated great honesty and integrity by not taking an oath contrary to the constitution of this very county.
E. New elections must be held with full application of Constitutional requirement under clause 62 etc. and not permitting any sectarian (Linguistic or religious etc.) parties.

Again as usual Justice [R} Irshad Hussain was receiving pieces of meat from Musharraf and was afraid of army's force, he didn't answer my letter. When a news reporter who knew about my letter asked him in a press conference, first Irshad Hussain denied receiving any complaint against referendum then when he was categorically told about my protest, he said the complaint was not in a proper format! What a massacre of justice at the hand of a judge! Mr . Musharraf was so afraid of truth that he ordered to burn all referendum related record. But really can he or anyone else burn and wipe out what is once written??
