Appeal to Chief Justice of Pakistan for Implementation of Constitution; Swabi Police flagrantly discriminated the aggrieved persons
Every one was silent spectator on stealing of motor bikes from the Judicial Complex Swabi but when a single car of a lawyer was stolen, the situation in the District Courts Swabi is evident from the reports in the newspaper.
The custodians of law used every pressure for the recovery of a single car which is otherwise considered unlawful but no one shed a single tear on the losses of the poor litigants who had come to the Judicial Complex and were deprived of their motor bikes.
In their cases, the police did not show the interest which was shown in the single case of a lawyer. I am happy that the police at least showed interest in a case but I deplore their apathy in the cases of other aggrieved persons.
My submission to the Chief Justice of Pakistan is that on one side in setting aside the NRO one point inter alia, was being its discriminatory nature but on other side, the lawyers used full force for the recovery of a single car and ignored the motor bikes of others without bringing it to their minds that their motor bikes had been stolen from the same Judicial Complex from where the car of an advocate has been stolen!
This incident has sent a message to the society to organise themselves and face even death for the achievement of any goal which they consider their right. In Pashto language there is a maxim that âthe wife of a rich person is sister-in-law of everyoneâ. Everyone showed sympathy to the lawyers but no one raised slogan for the loss of others.
The people realized from the time of recovery of the car that force is the recipe for every disease. Police was feeling no trouble on the losses of the people but became restive when the lawyers stopped attending the Courts and the Judges remained idle for the whole day and the people returned homes without justice. We witness daily that Police is targeted in every suicide attack. It means that the attackers have pinpointed the Police for the attacks after sufficient consideration. When the Police refuse to register the case of theft and the DSJ orders for the registration of FIR, then it means that Police is not performing its duty and needs some strict action.
The Judges also showed extraordinary interest in the recovery of the car of the Advocate while did not ask the Police that what was the result of some many other cases which had been registered prior to the theft of the car of the Advocate. Whether the FIRs lodged by other complainants would remain in the cold storages?
Whether it is not the responsibility of the Police to recover all the bikes stolen from the Judicial Complex Swabi? Whether Police discharged their responsibility by recovering a single car of a lawyer? Whether morally the lawyers were justified in spoiling the valuable time to Courts and people for the sake of their colleague and closing eyes on other aggrieved persons?
The Chief Justice should take action on this appeal and to ask the DPO Swabi to submit a report about the number of thefts and also the number of reliefs given to the aggrieved persons in the theft cases. Otherwise it will be discrimination in the worst form which is against the CONSTITUTION. I shall also submit a copy of FIR No. 363 dated 3-7-2009 about the motor bike theft as proof in which so far neither the police have done anything nor has contacted the complainant in this regard. I want the protection of the image from being tarnished which has now-a-days been made of the Judiciary and the Lawyers.
