In an article by BBC, they reported that Musharraf banned a bill for the application of Shari'ah in NWFP since, as he said, he wants his Country to follow,
"An enlightened, moderate form of Islam."
In addition to this, he denounced the implementation of the Shari'ah in NWFP as a "breach of human rights."
So what is he so fearful of regarding Shari'ah?
According to BBC, this would happen if Shari'ah is implemented:
Religious police would patrol the streets in Afghanistan, forcing women to adhere to a strict dress code and men to pray and grow their beards, among other things.
This is what the Kuffar and Murtadeen fear: Morality and the Haqq prevailing. They are afraid of following the Khilafah of "˜Umar ibn al-Khattab (radiyallahu "˜anhu) since there was a religious police established by him. Musharraf knows that if he allows the bill to pass, then this love and practice for Shari'ah will grow very quickly across the Country and the Haqq would be enforced on the land. And if that were to happen, Musharraf knows well that he would become a target. Why? Because Islam says he would become a target. The Shari'ah would demand Musharraf to be brought to justice.
The crimes of Musharraf are very simple: 1. Dismantling of the Shari'ah. 2. Killing Muslims who want to enforce Shari'ah in an Islamic manner. 3. Siding with the Kafireen in fighting the Muslims that want Shari'ah.
Just one of these crimes makes him a Murtad. Just one. But instead of one, he has these three major crimes on his hands. He is, undoubtedly, a Murtad according to Shari'ah. Keep in mind, I am not the one saying this. I am only repeating the statements from the book of Allah "˜Azza wa Jall and the Sunnah of His Messenger (sallallahu "˜alayhe wassallam) and the understanding of the Sahaba, Tabi'een, Taba Tabi'een, and the Salaf. So if one blames me for being arrogant or judgmental, we say to them: We rule by the law of Allah "˜Azza wa Jall and not our whims and desires. If you see that we are making a mistake in our ruling, then please, bring forth daleel from the Book and the Sunnah that what we are doing is incorrect.
Let's look at some of the proofs regarding this subject of how Musharraf is a Murtad and not a Muslim, even if he prays five times a day. One major book that I recommend on this subject "“ and there are many books on this subject written by Noble Shuyookh "“ is Shaykh Naasir bin Hamad al-Fahd's (fakkAllahu Asra), "The Exposition Regarding the Disbelief of the one who assists the Americans." He discusses the relevant ayaat, ahadith, and quotations from the many generations of Islam and also rebukes excuses and arguments for not rejecting the Kafireen, and Murtadeen.
Shaykh Muhammad Ibn "˜Abdul Wahhaab (rahimahullah) summarized the five types of Tawagheet in his "The Meaning of Taghoot" as follows; we will only mention the first three as they are the most relevant:
"The First: The Devil who calls the people to worship other than Allah. The proof for this is Allah's saying:
أَلَمْ أَعْهَدْ Ø¥ÙلَيْكÙمْ يَا بَنÙÙŠ آدَمَ Ø£ÙŽÙ† لَّاتَعْبÙدÙوا الشَّيْطَانَ Ø¥Ùنَّه٠لَكÙمْ عَدÙوٌّ مّÙبÙينٌ Did I not command you O children of Adam, that you should not worship the Devil? Verily, he is a plain enemy to you. (Yaseen: 60)
The Second: The tyrannical and oppressive ruler who changes Allah's rulings. The proof for this is Allah's saying:
أَلَمْ تَرَ Ø¥ÙÙ„ÙŽÙ‰ الَّذÙينَ يَزْعÙÙ…Ùونَ أَنَّهÙمْ آمَنÙواْ بÙمَا Ø£ÙنزÙÙ„ÙŽ Ø¥Ùلَيْكَ وَمَا Ø£ÙنزÙÙ„ÙŽ Ù…ÙÙ† قَبْلÙÙƒÙŽ ÙŠÙرÙيدÙونَ Ø£ÙŽÙ† يَتَØَاكَمÙواْ Ø¥ÙÙ„ÙŽÙ‰ الطَّاغÙوت٠وَقَدْ Ø£ÙÙ…ÙرÙواْ Ø£ÙŽÙ† يَكْÙÙرÙواْ بÙÙ‡Ù ÙˆÙŽÙŠÙرÙيد٠الشَّيْطَان٠أَن ÙŠÙضÙلَّهÙمْ ضَلاَلاً بَعÙيداً Have you not seen those (hypocrites) who claim to believe in that which has been revealed to you, and that which was revealed before you, and they wish to go for judgment (in their disputes) to the Taghoot, when they have been ordered to reject them? But the Devil wishes to lead them far astray. (an-Nisa: 60)
The Third: The one who judges by other than what Allah has revealed, and the proof for this is Allah's saying:
ÙˆÙŽÙ…ÙŽÙ† لَّمْ ÙŠÙŽØْكÙÙ… بÙمَا أَنزَلَ اللّه٠ÙÙŽØ£ÙوْلَـئÙÙƒÙŽ Ù‡Ùم٠الْكَاÙÙرÙونَ And whoever does not judge by what Allah has revealed, then they are the Kafiroon. (al-Ma'idah: 44)"
The Shaykh ul-Islam, Ibn Taymiyyah (rahimahullah) said,
"It's known by necessity from the religion of the Muslims and by the agreement of all the Muslims (Ijmaa'), that he who permits the following of a religion other than the religion of Islam or following a law other than the Shari'ah of Muhammad (sallallahu "˜alayhe wassallam), then he is a Kafir." (Majmoo' al-Fataawaa 28/524)
He, may Allah have mercy on him, also said:
"Whenever a person legalizes what is illegal by consensus or illegalizes what is legal by consensus or replaces the Shari'ah that is agreed upon by consensus, then he is a Kafir by the agreement of the scholars of Fiqh." (Majmoo' al-Fataawaa 3/267)
He, may Allah have mercy on him, also said:
"The Shari'ah revealed from Allah, which is the Qur'an and Sunnah that Allah sent His Messenger with, no one from the creation is allowed to leave it. And no one leaves it but a Kafir." (Majmoo' al-Fataawaa 11/262)
The Hafidh and Imam, Ibn Katheer (rahimahullah) "“ who is one of the most outstanding Mufasireen in Islamic History "“ says,
"So whoever leaves the clear-cut Law revealed to Muhammad bin "˜Abdillah, the final of the Prophets, and refers to other sources for judgment, such as abrogated laws, then he is a Kafir." (al-Bidaayah wan-Nihaayah 13/119)
He, may Allah have mercy on him, also said:
"And as for the royal policies, which the Tartars were ruled by, which were taken from their king, Genghis Khan, who laid down for them Al-Yaasiq, which is a book made up of laws which he took from different Shari'ah's. It is from Judaism, Christianity, the Islamic religion and others. Also it contains many laws which he took from his sheer thinking and desire. Thus, it became within his sons a followed law to which they have been giving precedence over ruling by the Book of Allah and the Sunnah of His Messenger. Whoever does this is a Kafir who must be fought until he returns to the rule of Allah and His Messenger. So no one other than He should neither rule in few nor many matters." (Tafseer Ibn Katheer, V. 2, page 63-67)
May Allah have mercy on you O Ibn Katheer! It is as if you are speaking of our time where the Apostates mix the Shari'ah with Kafir legislations borrowed from the enemies of Allah, yet Muslims have doubt and say, "They might not be Murtadeen; the issue is not clear!"
There are literally hundreds of proofs on this subject and that is why we strongly recommend the book by the Noble Shaykh Naasir. If anyone still believes, after being presented with all the proofs, that Musharraf and all the other Muslim Governments, their leaders, those under them, and their supporters are not Murtadeen, then he has become a Murtad himself. Keep in mind, my dear brothers and sisters, a Murtad is worse than a Kafir because they had the truth with them but rejected it due to their desires. This statement of mines should not surprise anyone if they are well-grounded in just Seerah alone as there are many incidents in the Seerah that prove this point such as the famous incident of Hatib ibn Abi Balta'ah (radiyallahu "˜anhu) and what the Sahaba and the hundreds of Shuyookh have said regarding this incident.
Some who are learned but have a misunderstanding or evil desire will say, "Dismantling the Shari'ah is a minor kufr ("Kufr duna Kufr") since Ibn "˜Abbas (radiyallahu "˜anhu) said this." This argument is argued by the Shuyookh from mostly Saudi Arabia who are paid by the Murtadeen regime.
To refute this, we will quote The Noble Shaykh, Abu "˜Abdillaah Sulaymaan Ibn Naasir Ibn "˜Abdillaah Al-"˜Ulwaan (fakkAllahu Asra) who said in his book, "Verily, the Victory of Allah Is Near" on pages 9 and 10:
"And what is said from Ibn "˜Abbas, may Allah be pleased with them, that he said, "Disbelief (Kufr) less than disbelief (Kufr)," is not authentic from him as it is narrated by Al-Marwazee in "Ta'theem Qadr As-Salaat" (2/521) and Al-Haakim in his "Mustadrak" (2/313) from the path of Hishaam Ibn Hujayr from Taawoos from Ibn "˜Abbas. However, Hishaam was weakened by Imam Ahmad and Yahya Ibn Ma'een and Al-"˜Uqaylee (Look to "Adh-Dhu'afaa'" by Al-"˜Uqaylee (4/337-338) and "Al-Kamaal" (7/2569) by Ibn "˜Adee and "Tah'theeb Al-Kamaal" (30/179-180) and "Hadee As-Saaree" (447-448)), as well as another group. And "˜Alee Ibn Al-Madeenee said, "I read upon Yahya Ibn Sa'eed, "Ibn Jurayj narrated to us from Hishaam Ibn Hujayr"¦" So Yahya Ibn Sa'eed said, "˜It is befitting that I disregard him.' I said, "Should I cross out his Hadith?' He said, "˜Yes." And Ibn "˜Uyaynah said, "We did not used to take from Hishaam Ibn Hujayr, that which we did not find with other than him."
And this (statement of Ibn "˜Abbas) is something that Hishaam narrated alone (i.e. without being affirmed by others) and furthermore, he contradicted others besides him from the trustworthy (narrators) as it was mentioned by "˜Abdullaah Ibn Taawoos from his father who said, "Ibn "˜Abbas was asked about His, the Most High's statement:
ÙˆÙŽÙ…ÙŽÙ† لَّمْ ÙŠÙŽØْكÙÙ… بÙمَا أَنزَلَ اللّه٠ÙÙŽØ£ÙوْلَـئÙÙƒÙŽ Ù‡Ùم٠الْكَاÙÙرÙونَ And whosoever does not judge by what Allah has revealed, such are Al-Kafiroon.
He said, "It is disbelief (Kufr)." And in a narration: "It is disbelief (Kufr) within him." And in another: "This is sufficient for his disbelief (Kufr)." "“ narrated by "˜Abdur-Razzaaq in his Tafseer (1/191) and Ibn Jareer (6/256) and Wakee' in "Akhbaar Al-Qudhaat" (1/41) and others with an authentic (Sahih) chain. And this is what is confirmed from Ibn "˜Abbas, may Allah be pleased with him, as he generalized the phrasing and did not restrict it."
