F.P. Report ISLAMABD: The Chairperson Higher Education Commission HEC, Dr. Javaid R. Laghari has declared Monday’s office orders of postings/transfers of various HEC officers made Qamar Zaman Ch. Secretary Ministry of Education & Trainings, null and void. The Chairperson HEC through a letter informed that the Commission has already decided that the Establishment Division does not have the jurisdiction to appoint the Executive Director of the HEC. As per Section-11(1) of the HEC Act, only the Commission has the authority to appoint the Executive Director. The Notification by the Establishment Division, therefore, has no legal basis. He also informed that under Section 11(1) of the HEC Act, the Commission has already granted 4 year tenure as Executive Director to Dr. Sohail H. Naqvi w.e.f. 16.9.2012. He further directed all HEC employees to follow Section-11(2) of the HEC Act to implement the decision of the commission.
How can HEC be so self-independent?
Much has been written and read in the past particularly since incumbent Chairman Leghari has taken up about appointments in Higher Education Commission but one way or the HEC is continues working at own and following its own rules and regularization as if it is a completely an independent & sovereign organization. Today Tuesday 4th December, 2012 I have read again in Frontier Post that Leghari as Chairman, HEC has stood up like rock against mighty Establishment Division telling them that administratively HEC does not come under its domain and umbrella which simply cannot and should not be left in lurk.
Dr Sohail Naqvi, Executive Director is the latest case who when his retirement date came he instead of going home finally with his bag and baggage, his employment has been extended an additional 4 years term which has been disapproved by Establishment division but Leghari is not at all pushed and maintained that as the laws of HEC it is he who controls HEC and not Establishment. What perplexes me at least that if Leghari is right in his assertion then the question am that why and how Establishment division can jump in and face humiliation and if it is the entity to enforce all the rules in the country about appointments etc then how Leghari could dare to over ride? One of the two either HEC or Establishment in wrong and if the executive machinery has failed to reckon who is right and who is wrong then help ought to be sought from Supreme Court of Pakistan to let the dust settle down once for all but it should not linger anymore because such like tug of war will incite and ignite others to stand up and refuse to listen to what Establishment Division says and it will be not than less an administrative disaster to be honest.
Will Supreme Court took an initiative on this burning issue as well?
