Assalamo Alaikum.

I request all Pakistani Muslims brothers and sisters to protest against Pervaiz Musharraf's numerous illegal and unconstitutional crimes and his massive killings and abduction of innocent Muslims. We must also protest his insult of woman which he is doing through propagating pornography which ultimately hurts woman more than anyone else. Musharraf is also borrowing enormous sum of money form IMF related agencies i.e Paris Club, ADB, WB etc. He is also selling precious Pakistani assets at throw away e.g. Pakistan Steel Mill and Habib Bank, etc. etc. Pervaiz Musharraf has also helped Bush and Blair to open up the massive drug trafficking from Afghanistan to the rest of the world thus again helping maiming and crippling hundreds of thousands of youth. The protest could be done in different manners e.g. Writing letters in Newspapers, nullifying the acts of Pervaiz Musharraf by respecting woman and family, Not keeping money in the banks, shunning away from all interest bearing accounts so not to permit thugs to use your money and suffocate poor, spread Islamic teaching all over the world,  showing the world true picture of Islam, learning and teaching your family and children Quran and its meanings. Not letting PML (Q) and MQM win through making broader alliances and supporting God fearing high character people. Exposing Pervaiz Musharraf' and his bosses' global terrorism. Trying your best to remove this dictator and traitor and bringing Allah fearing competent leadership.

The Military Dictator Pervaiz Musharraf who was brought in power by CIA after overthrowing democratically elected Prime Minister Nawaz Sharif, did it again. Last time he had illegally and unconstitutionally removing several judges who refused to violate the Constitution of the Country.
 
Pervaiz Musharraf who had violated numerous Military and Civilian rules and is notorious for corruption has created a new chapter in the history of judiciary. He house arrested the Chief Justice of Pakistan which he can not do by any law and for doing so he has abused Pakistan military and Para-Military forces. In reality the military and para-military forces MUST not have carried out his orders as they are also part of grave and criminal act.
 
Following were the faults of the Chief Justice Iftikhar Ahmad Chaudhary:
*      He was about to hear the petition that according to the constitution of Pakistan, the President can not be elected twice from the same parliament. First new parliament has to be elected which can then elect the President. Pervaiz Musharraf knows that if fair and free elections are held he will not get even 1% votes.
*      He cancelled the deal of selling Pakistan Steel Mill at throw away price to private sector which included Indian company. It is said that Mr. Shaukat Aziz who is milking money left and right from various banks also had share in this deal and was annoyed when Chief Justice cancelled the corrupt deal on appeal of chief of the Pakistan Steel Mill. Pervaiz Musharraf then sacked the Chief of Pakistan Steel Mill
*      He had banned dangerous kite flying as a festival as every year this results in killing of many innocent youth who run on the roads to catch the kites. Some people are killed on motor cycles as the sharp thread of the kites slashed the jugular veins of these victims. However Pervaiz Musharraf, who is bending backward to please his masters Bush and Blair, removed the ban, which again resulted in killing of 10 young people and seriously injuring about 400 others. Pervaizs (Musharraf and Ilahi) were held directly responsible for killing these people.
 
These are among many other disliking of Pervaiz for Justice Iftikhar Chaudhary. By Constitution and law Chief Justice can not be stopped form working and can not be sacked without strong recommendation of Supreme Judicial Council. Of course he can't be arrested. But that's what Pervaiz Musharraf has done.
 
It is the responsibility of the Supreme Judicial Council to immediately free Justice Iftikhar Chaudhary within hour and restore the honor and dignity of the Chief Justice as well Judiciary. The World Judiciary must also take serious note of this and must intervene.

The removal of Chief Justice Iftikhar Chaudhry by General Pervaiz Musharraf is unprecedented not only in Pakistan but in the entire British Commonwealth where judicial practice is based on the British legal system. This is an assault on the principle of separation of power and independence of the judiciary. This assault must be resisted by the judicial establishment and the legal profession not only for their own sake but also for the sake of the people of Pakistan who get redress against the excesses of the executive only through the judiciary. Mr Justice Iftikhar Muhammed Chaudhry had earned the trust and gratitude of the people by his judicial activism frequently taking suo moto notice of the negligence and excesses of officials. He had passed judgements against ministers when they had acted in defiance of law or against public interest. There is no doubt in anybody's mind that the effort to remove him from office is politically motivated. The present incumbent of the office of the President is also the COAS in defiance of every political, moral and legal principle. He is scared he could not depend on Justice Iftikhar Chaudhry to endorse his being elected President once again by the present assemblies or to continue as COAS into another term of office as President. He needed to induct a new Chief Justice who would be amenable to pressure. 

The Charge Sheet prepared by Naeem Bukhari against the Chief Justice clearly shows that an elaborate trap was prepared for him. The favours to his son were inducements that were turned around to make a case for misuse of authority. The most he could be accused of is sifaarish if he actually wrote a letter to a high official for his son. I believe he did no such thing. In any case, sifaarish is not an offence; it is the normal method of working in Pakistan. Insisting on rigid protocol or using aeroplanes of the provincial government is not improper. It would have been improper if he had asked an individual for a favour whose case was before the court. In the Steel Mills case, the Supreme Court judged improper conduct by the Prime Minister and the Board he presided over that decided to sell the Steel Mills in violation of procedures well below its market price. This Government took no action against them! Clearly, his ability to withstand pressure and building confidence of the people in the judiciary that the illegitimate rulers of Pakistan see as a threat. It is to preclude decisions against the Government on important constitutional points that are to be brought before the Supreme Court in the run up to the elections that the Chief Justice Iftikhar Chaudhry is sought to be removed. 

The situation is very serious. I said in an earlier column that General Musharraf has neutralised the three most important pro-Pakistan forces - Pakistan Army, Pakistan Muslim League and the religious political parties "“ all alone by himself. By being the sole representative and spokesman of the armed forces, he prevents any institutional input from them. By appointing carefully chosen henchmen as the President of the PML and the Prime Minister, he has become the "˜decider' in the Muslim League. Entrenched in the two, he makes daily assaults on the religious political parties and vilifies them as "˜obscurantist' and "˜extremists'. We now know what he means by "˜enlightened moderation'. It is eulogising Hinduism (celebrating Holi and Basant), preaching Hinduised "˜Sufi' Islam, and decrying Jihad. He is attacking the very edifice of the polity of Pakistan - vilifying Islam and extending patronage to opponents of the Two Nation Theory "“ notably the MQM. Now he has attacked the one pillar of the state "“ the judiciary "“ that had escaped erosion of authority despite military rule and was gaining public confidence. That cannot be allowed to pass. The people must support and the judicial establishment should play the lead role. 
I heard on TV a journalist making a very good point. He said that Prime Minister Nawaz had legal authority to dismiss General Musharraf from the office of COAS but he did not follow "˜due process' in exercising that authority. His colleagues in the Army decided they would not allow their chief to be so dishonourably dismissed. The result was that Nawaz Sharif was dismissed but General Musharraf escaped dismissal. The Judges can, and indeed MUST, also react with solidarity to safeguard the independence of the Judiciary. Fortunately, the law is even clearer in this case. The President has no authority to remove any judge let alone the Chief Justice. That authority is vested in the Supreme Judicial Council. The President has exceeded his authority by removing the Chief Justice and appointing an Acting Chief Justice before the Supreme Judicial Council could even hear the charges. The Acting Chief Justice, Javed Iqbal, Mr Justice Dogar who administered the oath of office to him, the Chief Justice of the Lahore and Sindh High Court who attended the swearing in ceremony, should excuse themselves from sitting on the Supreme Judicial Council to hear the reference. I hope Mr Justice Iftikhar Chaudhry would also raise an objection to their sitting on the Council on grounds of conflict of interest. If these judges did not exclude themselves, they would be seen as party to the conspiracy to remove from office their Chief Justice. One hopes that the Supreme Judicial Council, whoever its members, will say that Chief Justice Iftikhar Chaudhry has no case to answer. 
The military dictators, every time they usurped power, asked members of high judiciary to take a new oath swearing loyalty to them. After taking such an oath, the judges were bound to uphold the usurpation of power by invoking the dubious "˜doctrine of necessity'. One could understand their fear because the entire judiciary had been put under threat of losing jobs. This time, no judge is under threat of losing his job. This time the judges have the power and legal authority to make sure it is General Musharraf who loses his job. Will they come up to the expectations of the people or will they fail the nation once again?

According to the reports appearing in media in Pakistan, the Human Rights Commission of Pakistan presented a list of 148 missing persons in the Supreme Court on 8th March, 2007, and alleged that the country's intelligence agencies were responsible for their disappearance.

The bench headed by Chief Justice Iftikhar Muhammad Chaudhry had issued notices to the federal and provincial governments for March 26 for hearing. Amina Masood Janjua, who has been leading an effort to find the missing persons, including her own husband, presented another list of 59 missing persons to the SC. Her case was adjourned because the attorney general did not turn up.

The HRCP said in its petition that those who disappeared but were subsequently released had told the commission that the victims were picked up by intelligence agents, and subjected to prolonged isolation and physical and mental torture, with the object of extracting confessions and evidence against their own self or against their friends and relatives. "In some cases they were coerced into spying for the intelligence agencies. They also confirm that no legal authority, charge or allegation or the whereabouts of their place of detention were ever disclosed."

The HRCP claimed that the abductees were stripped, hung upside down, subjected to sleep deprivation, severe beatings, electric shocks, burning and injuries to vital body parts through various instruments.

"The testimonies received by the HRCP also revealed that the security services and the law enforcement agencies illegally maintain private prisons or safe houses equipped with all instruments of torture," says the petition.
The released people were also warned they would be picked up again if they made any disclosure or protest. Political parties like MMA have been critical of President Musharraf's tactics to hunt down Taliban leaders and other fugitives to please the administration of US President George Bush.
Some quarters allege that the persons suspected of knowing whereabouts of the underground Taliban and Alquida leaders are abducted the secret service and tortured to give them information so that they may collect the  hefty reward money. Some opposition leaders allege that the persons who protest against high handedness of Military rulers are also abducted and
 tortured.  

It is alleged that Iftikhar Muhammad Chaudhry was not willing to close his eyes on such human rights violations and other illegal or wrong actions of the Government. Therefore, he was suspended on March 9 and the procedure  to sack him initiated.

Besides opposition leaders, the associations of the lawyers all over Pakistan, former chief justices of the Supreme Court, senior lawyers and human rights activists have criticised President Gen Musharraf's decision to suspend Chief Justice Iftikhar Chaudhry on the charge of misuse of authority.

Asma Jehangir, chairperson of the Human Rights Commission of Pakistan (HRCP), opined. "The removal of the Chief Justice of Pakistan is a bitter blow to the independence of the judiciary. There were rumours that the government wanted to remove him."

"Such a dismissal can only be acted upon after the Supreme Judicial Council decides on merit against an accused judge. The speed with which the Chief Justice of Pakistan has been removed shows that the executive is nervous of an already tame judiciary."

 ISLAMABAD, March 9: Chief Justice Iftikhar Muhammad Chaudhry, who was suspended on Friday, has several important judgments to his credit, the most significant being the case in which he overturned the privatisation of the Pakistan Steel Mills and another in which he forced the government to locate "˜missing' persons.
 
During his 21-month tenure as chief justice, Justice Chaudhry initiated suo motu action even on a simple application filed by any aggrieved person. Despite his popularity among ordinary people, such moves were regarded by some members of the legal fraternity as being against the norms of the apex court.
 
There were so many suo motu actions against government officials, especially the police, that the chief justice had to set up a fully-fledged human rights cell in the apex court.
 
Contrary to public perception that victims of rape or other injustices were unlikely to get justice from lower courts, Justice Chaudhry opened the gates of the Supreme Court, bringing some relief to the needy.
 
In the privatisation of Pakistan Steel Mills, which is his most famous case, the chief justice's detailed judgment of Aug 8, 2006, had put the government under severe pressure by accusing it of holding the mills' privatisation in "˜indecent haste'.
 
In his judgment, the chief justice held that the entire transaction was the "outcome of a process reflecting serious violation of law and gross irregularities" in which various aspects of profitability and assets of the state-owned enterprise were totally ignored.
 
Likewise, on Feb 20, 2007, the Supreme Court upheld most parts of the Hasba Bill, re-legislated by the NWFP Assembly, though it asked for minor modification to clauses related to the definitions of the Mohtasib and religious scholars.
 
On June 27, 2006, the chief justice decided a case about Section 2A of the Services Tribunal Act 1973 and ruled that employees in most government corporations not governed by the statutory rules were not civil servants.
 
The most important and sensitive case to-date, which the chief justice had heard just a day before his removal related to "˜forced disappearances' and he had expressed strong disappointment over the government's failure to locate the whereabouts of the disappeared people because of their suspected links with Al Qaeda or other jihadi outfits.
 
On Jan 22, 2007, the chief justice, while leading a bench, had turned down the Punjab government's request to approve its decision to briefly lift the ban on kite-flying during the spring festival and asked the provincial government to celebrate "˜Basant' at their own risk. The apex court had taken suo motu notice on the reported deaths of children because of kite-flying.
 
Another important matter, which had deep political implications, was the case filed against educational degrees of Muttahida Majlis-i-Amal' s (MMA) members in parliament. They had been challenged on the grounds that the degrees issued by religious seminaries were not equivalent to graduate degrees.
 
On Jan 18, 2007, the chief justice had settled the custody dispute of UK-born Muslim girl Misbah Irum Rana through a compromise reached between her divorced parents.
 
On Jan 22, the chief justice had directed the Balochistan government to submit a detailed report about illegal allotments of 241,600 acres of land to ministers,
politicians and other bureaucrats in Gwadar. The order was passed on a petition filed by Bibi Zahra against the the Balochistan government's Board of Revenue.
 
The chief justice had also taken strict action against violators of the Supreme Court's ban on meals in weddings, forcing the government to adopt a private member's bill, allowing one-dish during marriages.
 
Due to the apex court's intervention, the government also had to take action against fake drugs and the use of tobacco in public places.
