Judicial Mischief?

The Kashmiris reeling under state torture mechanisms in various jails in Jammu Kashmir and India have been reported in these columns. It is no more secret that Kashmiris and other Muslims are ill-treated by Indian jails authorities and crudest interrogative methods are being administered on Kashmiris in Tihar jail.

Khursheed Ahmed Lone, arrested in 2005 on fictitious charges of  now famous "suspected terrorist" in Srinagar was undergoing punishment in jail without proper trial but was letter "picked-up" by Maharashtra police from Srinagar jail, but  nothing is known about his fate. The accused has been implicated in a number of other prefabricated cases. His incarceration in Mumbai is affecting the trial of Shabir Ahmed Bukhari of Kreeri Patan, (a law graduate), Shakeel Ahmed Sofi Abdul Rashid Kahan, his wife Roshni, Rouf Ahmed, Waheed Ahmed Dar, Abdul waheed Dar and Muhammad Maqbool Beig.     

On July 26 a Sessions Court in Kashmir asked Maharashtra government to produce a Kashmiri businessman languishing in a Mumbai jail for trial in his court. The accused is charged of facilitating a suicide attack on Prime Minister Manmohan Singh at Srinagar in 2005. The additional district and sessions judge Javed Kawos requested a string of Maharashtra government authorities including a fast track court judge, DG prisons, assistant Commissioner of Anti Terrorism Squad and a jail superintendent of Mumbai to expedite the presence of the accused before his court for trial.

The Judge requested the officials to look into the matter personally and direct the concerned officers to produce the accused before this court on August 13. seven more accused persons are facing trial along with the accused in four other cases. "Non production of the accused is stalling the proceedings in all the four cases. The other accused are unnecessarily suffering for no fault of theirs.

The judge hopes the directions would be carried out with positive response. Khursheed Ahmed Lone son of Abdul Gani Lone of Sopore, a fruit trader according to his family members was arrested by police at Srinagar on the suspicion of providing logistic support to two suicide bombers who were killed in an "encounter" with police near Dalgate, hours before Prime Minister Dr Manmohan Singh was scheduled to address a gathering at Sher-e- Kashmir Cricket Stadium at Srinagar in 2005.  Khursheed who was lodged in central jail Srinagar till March this year was taken to Mumbai by the sleuths of Anti Terrorism Squad Maharashtra. Since then the local courts have been asking the Maharashtra government to produce him for trial in Srinagar but the orders have been thrown to winds.
 
The Judge noted, "This court honored the letter of 9th additional adhoc sessions judge Fast Track court Sewree seeking the presence of the accused in your state. We handed over the accused to Vijay Solanki, a sub inspector in Anti Terrorism squad. We were assured that the subject would be produced before this court in the said case. All our directions in this regard are gathering dust. The accused has not been produced before the court till date." When a judge is powerless what about the ordianary Muslms in the coutnry?
 

Can Indian judiciary also be insensitive to human sufferings and play into the hands f the political victimization and anti-Kashmirism and anti-Muslims in the country?

India, QUIT, Jammu Kashmir!

All these year of brutality, genocide, rape and crime and illegal dealings in Kashmir by occupying Indian government, Kashmiris have not yet openly asked the Indian terrorist forces to QUIT KASHMIR", but now Hindus in Jammu have , especially the Hindutva out fit parties have done so by asking Kashmiris to quit Jammu.

The State President of Bhartiya Janta Party (BJP) on July 26 reiterated that Kashmiris should leave Jammu immediately.  "Those Kashmiri touts of National Conference, PDP, and Geelani", who have constructed houses in Jammu region should immediately vacate the land and go back to Kashmir. Last week they had asked "Kashmiri fundamentalists and touts" of National Conference (NC) and PDP putting up in various parts of Jammu to leave the summer capital immediately.  

 
BJP conisders and says that Congress, like PDP, NC, CPI, CPI (M), PDF and all other Kashmir-based politicians and separatists have communal mindset. Taking a dig at former Chief Minister Ghulam Nabi Azad, it was said, "It was during his minority status regime that all the Jammu-based Congress ministers joined hands to appease fanatics and reversed land transfer order under which 8000 kanals of land at Baltal had been transferred to the Shri Amamath Shrine Board (SASB) for creating "facilities" for the pilgrims." The BJP State President has repeatedly threatened "Kashmiri touts" of "dire consequences" if they don't quit the Jammu forthwith.   

Obviously, the fact that the reversals they received in their secret dealings to steal the forest land for temple structure constructions  have not been tolerated by Hindus who do every thing according to their wishes in

India and therefore felt shaken and rather threatened by this, has made them agitate over the issue to get the land back for temple purposes.

PDP should specify "peace process"

As usual by avoiding to state the obvious to Indian government and it terrorist forces, Peoples Democratic Party (PDP) Patron, Mufti Muhammad Sayeed has recently warned of more agitations breaking out in the state if Kashmir issue is not resolved forthwith. The pro-India Kashmiris leaders are good at confusing the innocent masses in using expressions in a clumsy manner. They are keen not offend the New Delhi leaders who are their "friends".

The much-needed peace process initiated in 2003 had started transforming the situation positively, not only within J&K but throughout the subcontinent., but military has not stopped killing the innocent Kashmiris. Sayeed said that the people of Jammu and Kashmir have waited too long for the confidence building measures to translate into real benefits and the escalating public cynicism has now started threatening the very essence of the peace process. The PDP Patron said, unfortunately, to the great detriment of the peace efforts, the political impetus to the confidence building process started waning discernibly, both within the State and at the bilateral level, during the past few years.

Sayeed said the Government of India shall have to make the first move in this direction by initiating with political courage the process of simultaneous implementation of the J&K-related inter and intra-state confidence building measures including rehabilitation of the victims of violence and allowing free movement of people and goods across the borders in the State.

At one point, the situation had given hopes that the expectations of the people of J&K would be fulfilled with the peace process. He said there is every reason to trust the democratic institutions and revive the peace process with political courage through concrete initiatives without getting discouraged by the recent acts of violence or giving in to the hawkish rhetoric. Mufti talks about reinforcing the resolve to work through peaceful means and through public participation towards restoration of permanent peace in the State and the region. But ha once again has no courage to spell out the resolve of freedom loving Kashmiris who want to get out of Indian clutches.

 The recent mass agitation over the diversion of State land to the controversial Amarnath shrine board precariously manifests the intense undercurrent of resurrecting disquiet and disillusionment fermenting among the people. At least now these leaders can openly ask India to quit Kashmir because the ordinary people have already shown the way. PDP should consider throwing its weight behind the freedom fighting leaders and secure freedom and independence form India. Other political leaders also could follow suit. Time will not wait for the pro-India Kashmiris leaders to take a long decision. They should realize that in India they cannot be respected in real terms, because Kashmiris are known in New Delhi as "terrorists". If they shift to India they will know that.

Kashmiris should make India see reaason to quit India voluntarily at least now. It is necessary to change the name of Srinagar into Islamnagar or something like that so that the message is clear to New Delhi and Governor.  Any ambiguity on the part of Kashmirs could prolong the Indan occupation of JK and genocides.

Will Kashmiris leader shed the decades' long hypocrisy and double"“talk favoring Indian and Kashmiris, which in real sense mean absolutely nothing but surrender to Indian boots?  It is time the Kashmir freedom fighters give out a wake up call to these pro-Indian leaders who still sit on the fence. They should also talk to the pro-India leaders on the need to regain soverignty back from occupying India. Time is indeed running out, pretty fast!
