SUBJECT: REQUEST FOR THE APPOINTMENT OF A HIGH-POWERED COMMISSION FOR THE CRIMINAL INVESTIGATION INTO MUCH BELOW MARKET PRICE SALE OF THE GOVERNMENT PROPERTY IN TOKYO BY THE ACCUSED, MR. KAMRAN NIAZ, EX-AMBASSADOR, AND INTO THE COMPLICITY OF THE FOREIGN SECRETARY, MR SALMAN BASHEER TO HIDE THIS FRAUD
AND HUSH ?UP THE INVESTIGATION

Reference: Our Letter of complaint to the Honorable Attorney General of Pakistan, Islamabad on the subject: "COMPLAINT AGAINST SALE OF PLOT/BUILDING OF PAKISTAN EMBASSY, TOKYO, JAPAN"
Your Excellency,
Enclosed please find all the documents referred-to above to fully understand the nature of our complaint and for the appointment of a high-powered Investigation Commission to look into the complaint of the Pakistan community, as represented by our organization.
As you may see it for yourselves, we have got disappointed with the silly and ridiculous reply from the Ministry of Foreign Affairs to our complaint, which was referred to it by the Honorable Attorney General of Pakistan. It shows a clear attempt to cover up the fraudulent activities of the accused ex-Ambassador, Mr. Kamran Niaz. Therefore, we are approaching Your Excellency to take strong action after seriously looking into our complaint, for which we have spent lot of time and money only with the spirit of patriotism to save the precious property of our country from usurpation by any selfish individual.
Mr. Salman Basheer, Secretary, Ministry of Foreign Affairs, does not appear to be directly involved in the fraudulent sale of the Pakistan Embassy plot in Tokyo, but the way he has treated above referred-to letter from the Attorney General of Pakistan and the manner and the nature of his reply to it is a clear proof of his complicity in trying to hide the crime of his life-long fast friend, ex-Ambassador, Kamran Niaz. We doubt his complicity in the matter due to following reasons:
1. Had his boss the Foreign Minister referred the same letter to him; he would not have treated it in the same way as he has done in case of the Attorney General. He did not bother to reply himself directly to the Attorney General. Mr. Basheer has directed a junior officer to deal with him. The Attorney General is a political appointee, directly appointed by the President of Pakistan, Asif Ali Zardari. His rank and status is much higher than an ordinary salaried employee and a self-serving bureaucrat of the Ministry of Foreign Affairs like Mr. Basheer. His position is even higher than all those 57 or more Ministers, appointed by the President and the Prime Minster of Pakistan. But he has been treated as an ordinary person, as if lower in rank than himself, who is actually nothing more than an arrogant bureaucrat like those of the old British days of our period of slavery. This shows how much weight he has given to the Attorney General's letter. This is an insult to his position and rank.
2. Secondly, the Foreign Secretary has further insulted him by treating him as an irrelevant outsider unnecessarily interfering in the routine matters of his Ministry. His style of reply is that as if thousands of such inquiries come to him daily and he disposes of them all in a routine manner and is not interested to look into the matter of our complaint seriously, as if it is none of the Attorney General's business to interfere in the daily routine affairs of his Ministry. It is a matter of his routine handling by his junior staff. The ridiculous Ministry reply indicates as if the Attorney General, as an outsider, has nothing to do with the matters of his Ministry. With this background in mind, please see the words in his reply, " (This matter) has also been earlier brought to the attention to the Ministry of Foreign Affairs, Islamabad, and the Mission from different sources which have been replied in details." These words indicate that the Attorney General should keep his mouth shut in this matter. This is not a proper reply to the letter, just another insult for the Attorney General.
3. Thirdly, he has aggravated insulting the Attorney General by not caring a fig even to send any copy of the replies his Ministry has been giving to all other such complaints in a routine way. He is treating the Attorney General as Mr. Nobody to poke his nose in this matter.
4. Foreign Secretary's absurd reply containing some irrelevant substance is reflected in these few words, ""¦the sale of plot in Tokyo and the construction of new building was as per swap arrangements in which no money from Government of Pakistan was spent." That is what we are contending and complaining against and request a criminal investigation into the matter. Our contention is that if it was a swap, it was an unequal swap. Our Tokyo plot was worth about twice the value on which it has been given away in the name of swap. In the said swap arrangement, our plot was valued for about 63 billion Yen only by the Nomura Real Estate Company, whereas we can provide you reliable evidence that it was worth more than 130 billion Japanese Yen. In addition to all those swap arrangements; Government of Pakistan would have still claimed about 57 billion Yen cash as an extra compensation for our embassy plot.
5. Where has all this money gone? Why it was not officially claimed? Who is the beneficiary of this big amount which has vanished secretly? These are all the matters for whose answers; we can provide you solid and undisputable evidence along with some authentic documents containing facts, figures and witnesses, which would prove the usurpation of Government property in Tokyo. Pakistan community in Japan, which is represented here by our organization, Pakistan Association (Elected) has spent time of over 6 months and several million Yen worth of money to collect all this reliable evidence from authentic sources.
6. Another silly suggestion has been made in the 2nd paragraph of the Foreign Office letter referred-to above dated 27th October, 2008 that we should go to the acting Head of Mission in Tokyo to get detailed explanations of the case. We already know the details of this case much better than the Acting Head of Mission. We are complaining that whatever has been done is a case of fraud and a matter which calls for the appointment of a high-powered Investigation Commission, not just an explanation by someone who himself does not know all the secret dealings involved in the case.
7. We have already gone several times through all that process of hearing the details of the case, which is mischievously suggested in the Foreign Ministry letter to divert attention from the crux of our complaint. Instead of the present Acting Head of Mission, we had direct talks with Mr. Kamran Niaz, the accused, who was the actual Head of Mission in Tokyo at the time of the sale of the embassy plot. In a last meeting, the accused ex-Ambassador gave a detailed hanky-panky explanation of the case in a meeting of the Pakistan community at the embassy premises. Finally, he asked that after hearing all his detailed explanation of the case is there still anyone who doubts the integrity of the accused ex-Ambassador. The undersigned raised hand in the meeting and said that I can prove your fraud, if you grant me a 30-minute private interview here and now. But the accused did not agree and asked to come later after getting a proper appointment with him. Later on, he never gave any appointment for this purpose despite several attempts by the undersigned to get it. All this conversation in the meeting is recorded in a video, which the undersigned can produce any time before any relevant authority appointed by the government of Pakistan to investigate this fraud.
8. The very fact that the accused ex-Ambassador avoided to face us creates doubts about his integrity. A clean man would have welcomed such an opportunity.
9. We are not seeking any explanations by anyone. We already possess evidence to prove the fraud in this case. We can provide all this evidence with all facts, figures and the necessary authentic documents; if you initiate the process of official Investigation into this matter, we will provide all available evidence with us.
10. You might have observed from our submissions above that the first 4 paragraphs of this letter provide clear and ample evidence of the complicity of the Foreign Secretary, Mr. Salman Basheer in this matter. He is clearly trying to hide the crime of his life-long fast friend, Mr. Kamran Niaz, ex-ambassador in Tokyo and avoiding to take any serious action in this matter. With such a gentleman at the helm of the Ministry, who is trying to hush-up the matter, no honest and impartial Investigation can be conducted any further. He should be removed or transferred from this post during these Investigations.
11. Please note that we will get no personal gain by taking all this trouble. We are doing all this with a spirit of patriotism and to serve our country and the Pakistan community in Japan. We cannot remain a silent spectator if any ambassador of Pakistan is taking personal advantage of his position against the interests of our beloved country. We have the evidence to prove he has usurped official government of Pakistan property for his personal benefit. He is now Director of a big steel company after retirement with ample money for investing in such a big steel mill project. Can a government employee save so much money for such a big investment after retirement?
