"Courageous" Judiciary and President Zardari Politics

Even if it is said that three "courageous" Supreme Court judges disqualified two most popular & courageous political leaders, one of them was the Chief Minister of Pakistan's largest province, it wouldn't make sense. The "internal courage" of Supreme Court present judges was clear when:

 

  1. They had betrayed their fellow Chief Justice Ifthikhar Chaudhry and took PCO oath under Musharraf's 3rd Nov 2007 martial law

 

  1. They refused to acknowledge 7 member bench decision passed on 3rd Nov to nullified Musharraf's dismissal of constitution

 

  1. They formed a new bench under the "˜leadership' of Abdul Hameed Dogar and nullified his own Chief Justice decision

 

  1. They passed an order to make the actions of 3rd Nov 2007 as part of constitution without the endorsement of National Assembly & Senate of Pakistan

 

  1. They withheld the BA degree requirements "“ regardless of its validity- within a day, because it was needed by "someone" who was looking for the highest public office in Pakistan and he wasn't a graduate

 

  1. They kept their eyes blind when their present "boss's daughter" had violated the whole system of examination and successfully gained 21 additional marks which she didn't deserve. No suo moto action!

 

Who says that our highest judiciary is independent? People of Pakistan are witnessing lingered judiciary since its inception under the banner of "doctrine of necessity" and Abdul Hameed Dogar along with his fellow companions is the most recent example of this doctrine. Sometimes I think, "˜how many innocent people have been hanged, how many have been kept behind the bars for life imprisonment, how many failed to get justice upon the orders of this lingered judiciary!!!'

 

With this background, when "innocent" stalwarts of PPP say that "the decision against Sharif Brothers' was given by judiciary and not by President Office" it looks like that an ostrich is hiding his head under sand!

 

 All this was planned since long and yesterday it was unfolded only "“

 

  1. Zardari invited Sharif Brothers to join 18th Feb elections, to divide Muslim League votes between N and Q leagues. PPP to take advantage.

 

  1. Zardari showed his "˜reconciliation approach' towards N league after partially winning elections, to secure Prime Minister position for PPP

 

  1. Zardari made "judges restoration" accord thrice to buy time and strengthen his party  and central govt

 

  1. Zardari initiated "Musharraf's impeachment  process with the help of N league, to secure that position for himself

 

After knowing all this "“ if N league says that they are ditched then it would be true. After N league, Q will be dealt like that and most probably MQM will be next in line as they wouldn't feel comfortable with President Zardari!

Nadia Khan has correctly analysed the political crisis. If PPPs coalition partners fail to realize that Zardari's bonapartism will not end on PML (N) they are utterly wrong. They will get their due share from corrupt Zardari in their own turn. I differ with Nadia Khan's views a bit on the matter of judges and the lawyers movement. By picking Iftikhar Chowdhary as their leader lawyers have exposed their preferences and given way to credible and sustainable argument by opponents of the movement that Iftikhar Choudhry is also a PCO judge. In fact superior judiciary of Pakistan as a whole comprises hand picked judges including Iftikhar Choudhry through most non transparent process and this is the time we should fight not for or against judges but for independent and accountable judiciary appointed through a transparent process by a non partisan judicial commission on the basis of stringent selection criteria with emphasis on competence and integrity. The Commission should be elected by the lawyers community. The judiciary should be directly accountable to the people of Pakistan through the judicial commission. The commission should be headed by a non lawyer and apolitical notable person of highest integrity and membered by apolitical notables of cross section of society with equal number of lawyers and non lawyers. This Commission should directly entertain public complaints against misconduct of lawyers and judges and take punitive action. Such a Commission has already been formed in Britain under judicial reforms of 2004 and is functional. Civil society of USA is also fast moving forward towards such judicial reforms. Today Pakistan needs competent and incorruptible judiciary fully independent from political influence and accountable to the people of Pakistan and not politicians
