Dear Chief Justice: Assalamo Alaikum.
All praises are for Allah, the One and Only God, the Creator and Sustainer of all the Worlds, the Most Merciful, the Most Compassionate, the Master of the Day of Judgement. Him alone we worship and Him alone we ask for help and Him alone we ask for the guidance to the straight path, the path of those upon whom He has showered His mercies and not of those who went astray and those received His wrath. Allah's blessings be upon the last and the final messenger of Allah, Muhammad son of Abdullah, the servant and the messenger of Allah.
As we must not be like Bani Israel who punished their weak and let their rich and powerful go off the hook and as you and your colleagues are sitting at the highest chairs of justice I bag your kind and urgent attention to one of the most heinous crime committed by the state, using the state force against its defenseless civilians. Of course numerous such crimes had taken place in Pakistan and at times we feel that it has become norm rather than exception. However the incidence of Bajor killing has some unique features:
- The mass murderer has accepted the responsibility of killing
- The mass murderer has accepted that he has violated Constitution and law as the Constitution and the law grants full protection to the citizen against state's action against civilian without giving him/her full right of defense.
- The mass murderer has used State machinery, resources and personnel to Carry out the crime
- The reaction of this mass murder had resulted in a counter bloody action by some desperate and frustrated individual who killed himself along with killing of many young recruits of Pakistan army. It can be said safely that had the first illegal and extra judiciary action by the state not occurred, the reaction would have not occurred too and thus lives of over 100 innocent citizens of Pakistan and human beings wouldn't have perished.
- Pervez Musharraf had threatened that he would do similar acts in future which logically can again result in counter actions and thus a bloody mess similar to Iraq may happen in Pakistan when no one would be safe.
Please let me quote here Constitution of Pakistan:
5.
(1)
Loyalty to the State is the basic duty of every citizen.
(2)
Obedience to the Constitution and law is the [4] [inviolable] obligation of every citizen wherever he may be and of every other person for the time being within Pakistan.
6.
(1)
Any person who abrogates or attempts or conspires to abrogate, subverts or attempts or conspires to subvert the Constitution by use of force or show of force or by other unconstitutional means shall be guilty of high treason.
(2)
Any person aiding or abetting the acts mentioned in clause (1) shall likewise be guilty of high treason.
(3)
[5] [Majlis-e-Shoora (Parliament) ] shall by law provide for the punishment of persons found guilty of high treason.
9.
No person shall be deprived of life or liberty save in accordance with law.
10.
(1) No person who is arrested shall be detained in custody without being informed, as soon as may be, of the grounds for such arrest, nor shall he be denied the right to consult and be defended by a legal practitioner of his choice.
(2) Every person who is arrested and detained in custody shall be produced before a magistrate within a period of twenty-four hours of such arrest, excluding the time necessary for the journey from the place of arrest to the court of the nearest magistrate, and no such person shall be detained in custody beyond the said period without the authority of a magistrate.
Here persons are not even arrested or detained, they are just simply murdered depriving them all defense.
My Honor: can you imagine the feelings of mothers and sisters of these innocent souls. As humanity is one and as killing even a single human being is like killing entire humanity and as providing quick and swift justice saves lives, I therefore request your honor to take a suo motu action against illegal, extra judicial murder of 83 innocent children in Bajore by Pervez Musharraf. I request you to kindly suspend him and his Government through the force of law and appoint a care taker Government till the result of judicial proceedings are carried out in public and the verdict implemented.
