Respected Sir,
Reference your Memo: No. 3534-G Dated Swabi the 21-5-09 and Endst: No. 3535-G on the subject noted above addressed to all the Principals/Head Masters/DDOs of Tehsil Swabi, Lahor and Topi who in turn forwarded to the Head Teachers of the respective Schools.
(1) That the undersigned is a Primary School Teacher and thus belongs to the Class of servants on which the Rules of Vacation Department applies. Normally, he avails all the vacations of the year in which he is permitted by the Rules not to attend the school but the above stated letter has curtailed his vacations for the year of 2009 and he has been asked to perform the duty in the School to remain the school to safeguard the assets of the school. So he is performing his duty like the other Government Servants are performing.
(2) That Supplementary Rule 266 made under the Fundamental Rule 82 (a) provide that "A Government servant serving in a vacation department shall be considered to have availed himself of a vacation or a portion of a vacation unless he has been required, by general or special order of a higher authority, to forego such vacation or portion of a vacation provided that, if he has been prevented by such an order from enjoying more than fifteen days of the vacation, he shall be considered to have availed himself of no portion of the vacation." My contention is that the teachers should be considered like other Government Servants while calculating their leave for the year 2009 and if the situation remained so then for the subsequent years.
(3) That normally, when a teacher is appointed to work either in the General Elections or Census duty of enumeration of houses or men, women and children, he is given proper remuneration for the work. Whether the teachers who have been restricted to work from dawn to dusk would be properly remunerated in shape of "Double Duty Allowance" or not? Whether they are eligible for "Special Pay" "Honoraria" or any such amount by different description for doing more work in these "Unusual Circumstances" or not? Whether the lives of the teachers and Class-IV are not at risk in performing their duty in their schools like the Police men? If yes, then whether they are not eligible for "Double Basic Pay" of their salaries or not"?
(4) That the Commissioner Mardan Division, Mardan has stated at the end of his Office Order No. 1559-75 Dated 11-05-09, "that any loss or damage if caused to any asset of any educational institute in Mardan Division shall be the entire responsibility of the Principals/Head Masters/Incharges concerned and actual amount of any such loss or damage shall be recovered from his/her salary".
A question arises, how many officials of the law-enforcing agencies, who have been appointed for the protection of the assets of both the Government and the People, have been charged for the negligence in their duty and the amount as damages to both the Government and the People have been recovered from their salaries? Instead their salaries were doubled and more facilities were provided to them, then why this brow- beating with the teaching staff?
(5) That the worst sufferers of this arrangement of the duties of both the males and females teaching staves are the children whose mothers and fathers both belong to teaching cadres and compulsorily remain out from the homes from the morning to the evening. Who will look after them in their houses when their fathers and mothers remain out on Government duty for all the day? Whether it is justice to the children of the serving parents to keep them without parents for all the day? What is the difference between these children and the IDPs? The IDPs have left their hearths and homes due to aerial and ground bombings while the children of serving couples have been rendered parentless by the orders of their Superiors. How long this situation will remain, no one is certain. The issue of IDPs have not only created problems for the Government but has also disrupted the smooth domestic relations of the blood relatives. This is one of the basic fundamental human right issue and needs the attention of the Government and the Supreme Court on priority basis.
